In the United States, there are three types of patents available—one for plant products (if you invent a new type of flower or grass), one for a new design (for ornamental use), and one for a utility-related invention (new machinery process or manufacturing equipment). To obtain a patent, you must apply for it through the United States Patent and Trademark Office. You’ll need to have plenty of documentation about what it does, how it works, how you built it, and you’ll need to show it is something completely different from anything else on the market. Additionally, your product can’t be for sale unless it’s only been available less than a year. You will need to do some research on all of these requirements to make sure your product is eligible for a patent. You will also want to have a solid market analysis to back up your patent-purchase, since it will cost around $1500 to get it by yourself.
